Consumers court is non-functional in District Gautam Budh Nagar. The state of Uttar Pradesh is ruined by Anarchy. People are helpless. We are constantly cheated and no where to go to. The police never helps and here I recount the state of Consumer's court.
I drove 25 Km to go and file my following case against a company who cheated me of huge amount of money. First the court employees wanted me to take a paid lawyer. When I insisted that it is not needed, they did file the case and I suspect that they did not proceed with it due to some favours received by the respondent party. Never anything was proceeded in this case and they may have marked my absence and cheated me by not informing me.
Here are the details. May be this blog can help people not to be cheated by this company.

If the government is honest towards its people who vote it to power, such a company should shut down. They work without any expertise, just anybody sits there, hire some labour and start making huge amounts of profits by cheating public. My picture clearly show how badly the work is done and that MS Nilima did not know her job and she hired the non-experts to make her huge profits.
Case of cheating and by Chandraneel Modular Furniture (P) Ltd. Dealing

Here are the series of events of this case and my
prayer to the Honourable consumer court of District Gautan Budh Nagar.
1.
First hand written estimate given on 10.1. 2014.
(document attached) to me by Ms Nilima Ladd in her office. An advance of 2500
Rs (cash) was taken one week before this date for making the map. This money
was to be deducted from the kitchen price.
2.
Computerised
agreement was given on 31.1.2014 and on the top of it was written
‘estimate’ for 210550 Rs (two lakh, ten thousand five hundred and fifty
rupees).
3. One
Lakh (12.2.2014 and 26.2.2014 two cheques of 60000 and 40000) was taken as
advance for the kitchen and I was told that the rest should be paid in cash (copy of the payment from bank book
attached)

No receipt was issued for this money throughout
the year and neither any work was done. I was told on the phone that Mrs Ladd
was away to America. No receipt was issued for my amount received despite my
demanding it again and again.
5.
After great persistence, the first delivery of
boxes was done in 26.2.2015 (one year
after taking one Lakh) and was first time the receipt was issued for only
44255 Rs. (document attached). Mrs
Nilima Ladd wanted this money in cash (not in cheque) and did not want to
deduct from the one lakh advance paid one year ago. She really troubled and
harassed me to pay her more money at this stage which I refused to pay.

Work was done in bits and pieces and finally in
August 2015 I was strict with Mrs Ladd to get the work finished. She demanded
47500 Rs, (again in cash) before next step which was paid but got no receipt at
the time of payment. I was warned to keep the similar amount ready on delivery
of shutters which were delivered in October.

After having received the final payment, (a total of 218085 Rs) she provided me with
four more receipts (Five receipts
attached). Combinations of the total five receipts was strange, some
correct with Vat and the others not. She did the splitting on her own without
any regard to the time span, vat and income tax.

12, 2015, Mrs Nilima Ladd had received from me a total amount of two lakhs
eighteen thousand and eighty five 218085 Rs. but still she did not want to
finish the work and was asking me to pay 32500 more and that too before
finishing the work. She left without completing the kitchen and the
complimentary furniture she has promised. Here are some whatsapp messages of
oppression demanding the above undue amount from me to complete my
kitchen.

, we can have a via media because I also wanted to end this issue ! I will send
Baiju with the material to complete the remaining work ! Before starting please
pay him 25000/- & remaining after completion ! If this sounds good to u
then please let me know ! It will
[27/10 09:15] Nilima: Remaining work is not more than 5000/- ! I am asking you to pay 25000/- ! I have to take 32500 /- l would like to complete ur work as early as possible ! Pl tell me according to u what is left ?

Charges
against Chandraneel Modular furniture and kitchen (Owners Ms Neelima Ladd and
her husband.
1.
This company has cheated me hugely by over charging and charging double for
everything.

The company took one Lakh advance and did not
supply me anything until for one year.
v
The company has been torturing me each time by
not doing my work and all their workers were busy when I had time to get work
done. At my age, I had to live with an improvised kitchen one floor high for
two years due to this company’s carelessness and greed.

After charging an exaggerated sq. foot
price(1450 per sq. foot as compared to even the present market price of 1300 sq
foot for this kind of material), the company charged extras which a sq foot price includes. Extras for delivery,
installations, legs, organiser, ply, drawers, etc. Innotech drawers, which cost
about 3500 Rs per piece is charged as 10,000 Rs, which is more than double the
amount even what is they charge in Germany. Over all, the company charged me
100% more than the actual price of the kitchen.

Promised a tall storage unit and simply made a
cupboard without accessories (photograph

The company did not supply to me the accessories
for the other units as well which is part of the sq foot price. At a rate of 1300
sq. foot, in a kitchen of this size in the market, 8 to 10 accessories are
supplied by most dealers. I had to buy my own dustbins and other accessories. One
single organiser was supplied and is charged extra for 4500 Rs. The other two
organisers I had to buy myself.

Three glass units are fixed and I am charged for
six for 2500 Rs each.

The soft closing doors do not close properly as
the company cheated on the hinges by putting one smaller hinge and one correct
hinge.

The company had promised me two kitchen cabinets
for my upstairs kitchen in the mentioned price and it is written on the
handwritten agreement by Mrs Nilima Ladd. They did not supply.

The company did not finish my kitchen and
instead started further torturing me to pay them 32500 Rs. more without any
reason. (The evidence from whatsapp message is provided above).
2.
The company has no proper technical expertise and has made gross technical
errors. Mrs Nilima Ladd dealing with my kitchen has apparently no technical
knowledge and just depended upon average carpenters. Mrs Ladd took me several times to Home Town and copied their kitchen
designs. She assured me that she will provide me the quality I saw there. She
could not do that and there are numerous technical errors.

There were huge gaps between the furniture and

The kitchen sink and its tap were not made
according to the drawing they supplied initially. The tap is put too low and as compared to the
height of the sink, which was increased later. Therefore it is hard to wash a
big cooking pots and pans without banging into the tap. (photograph supplied)

There is no connection between the organisers
and the doors as it should be in a modular kitchen. The drawer organiser does
not open or shut properly and is not soft closing as was promised to me after
seeing Home Town Kitchens.

The two sides of the doors are not at the same
level (photograph supplied).

The handles are of the lowest quality and will
not be able to wear the weight and frequency of the doors, especially those of
innotech drawers.
Prayer to the Honourable Court
1.
It is requested to the Honourable Court to
punish appropriately the above quoted Private Ltd. company for cheating,
forgery, financial irregularities and for leaving the work incomplete,
therefore also denying the guarantee for the kitchen for one year.
2.
It is requested to the Honourable court to get
me back at least 1 Lakh excess charges from the above said company.
3.
It is
requested to the Honourable court to let the company pay me the compensation
for the financial exploits and the delay and torture the company has subjected
me to for nearly two years due to the lack of appropriate kitchen. They have
tortured me and exploited me financially due to my being an elderly woman and
alone.
